Nigeria's carbon market is open, but its rules are still settling. The Climate Change Act 2021 established the National Council on Climate Change (NCCC), and the National Carbon Market Framework approved by the Federal Government in 2025 sets out how voluntary projects and Paris Agreement Article 6 transfers are to be registered and authorised. Detailed Carbon Market Regulations are still pending and have not yet been issued.

In that environment, developers, buyers and funds need three things: clean title to the credits, documented community consent, and a clear regulatory position with the NCCC. Dealtran provides the legal, land and regulatory work that makes Nigerian carbon projects bankable.

What we advise on

  • Carbon-rights and land title review.Statutory and customary land checks, confirmation of who holds the land and the emission reductions, and carbon-rights assignment, so credits can be transferred and sold.
  • Community consent and benefit sharing.Design and documentation of free, prior and informed consent (FPIC) processes, benefit-sharing agreements and grievance mechanisms that meet registry standards (such as Verra and Gold Standard) and buyer requirements.
  • NCCC registration and authorisation.Project registration with the NCCC's Carbon Market Office, applications for letters of authorisation for internationally transferred mitigation outcomes, and written regulatory positions on ownership and competing claims where the law is not yet settled.
  • Transaction documents.Emission reduction purchase agreements, forward offtake and prepayment agreements, and developer, originator and joint venture agreements.
  • Regulatory due diligence.Nigerian legal and regulatory reviews for buyers, investors and development finance institutions assessing a project or portfolio.
  • Policy tracking.Updates on the pending Carbon Market Regulations and NCCC procedures as they are issued, and what they mean for projects already in development.
